1. Acceptance of Terms

By accessing or using the RakuWP website, management panel, or WordPress plugin (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree to any part of these terms, you must not use the Service.

2. Description of the Service

RakuWP is a modular WordPress plugin platform that provides a suite of service modules managed through a centralized online panel. Available service modules include, but are not limited to: Turbo Cache (full-page caching), CWV Analysis (Core Web Vitals monitoring), Remote Management (multi-site administration), Passkey Login (passwordless WebAuthn authentication), Backups (automated site backups), Block Editor (custom Gutenberg blocks), AI (AI-powered content tools), List Customizer, Security Basics (security hardening and access protection), Monitoring (login monitoring, file integrity, malware scanning, and vulnerability tracking), SEO (search engine optimization tools), and Simple Analytics (cookie-free website analytics). The panel provides license management, site administration, support tickets, and subscription billing.

Service modules may be added, modified, or discontinued over time. We will notify active subscribers of any material changes to services included in their plan.

3. Account Registration

To use the Service, you must create an account with accurate and complete information. You are solely responsible for maintaining the confidentiality of your login credentials, including any passkeys registered to your account, and for all activity that occurs under your account. You must notify us immediately if you suspect unauthorized access.

4. Plans, Pricing, and Billing

RakuWP offers a free plan with limited features and paid subscription plans with additional service modules, site slots, and priority support. Paid plans are billed on a recurring basis (monthly or annually) through Stripe. By subscribing, you authorize us to charge your payment method at the beginning of each billing cycle.

Prices may change with at least 30 days' prior notice. Price changes take effect at the start of your next billing cycle. You may cancel your subscription at any time from the panel; your access will continue until the end of the current paid period.

5. Refund Policy

We offer a 7-day money-back guarantee on all paid plans. If you are not satisfied with RakuWP for any reason, you may request a full refund within 7 days of your initial purchase or the most recent renewal date.

How to request a refund: Contact our support team with your account email address. Refunds are typically processed within 5–10 business days and returned to the original payment method via Stripe.

Eligibility: Refunds apply to the current billing period only; previous billing periods are not eligible. Only one refund may be claimed per subscription.

After a refund: Your subscription will be cancelled and your license downgraded to the free plan. Premium service modules will be deactivated, but your account, sites, and data will remain accessible. You may subscribe again at any time.

6. License and Usage Rights

Each license grants you the right to install and use the RakuWP plugin on the number of WordPress sites specified by your plan. Licenses are tied to your account and are non-transferable. You may not share, resell, redistribute, or sublicense your license key.

You may not reverse engineer, decompile, modify, or create derivative works based on the plugin code. Automated scraping, crawling, or bulk access to the panel API beyond documented endpoints is prohibited.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful or fraudulent purpose
• Interfere with or disrupt the Service, servers, or connected networks
• Attempt to gain unauthorized access to any part of the Service
• Upload malicious files or code through the support system or any other channel
• Use the REST API beyond the documented rate limits or in a way that degrades service for others
• Misrepresent your identity or affiliation when contacting support

8. Support

Support is provided through the ticket system in the panel. Free plan users receive standard support. Paid plan users receive priority support with faster response times. We make commercially reasonable efforts to respond promptly, but do not guarantee specific response times. Support is provided in English and Spanish.

9. Intellectual Property

All content, code, designs, trademarks, and documentation associated with RakuWP are the intellectual property of RakuWP and are protected by applicable copyright and trademark laws. Your subscription grants a limited, non-exclusive license to use the software; it does not transfer any ownership rights.

10. Relationship with WordPress

RakuWP is an independent product and is not owned by, operated by, sponsored by, or affiliated with the WordPress Foundation or Automattic, Inc. "WordPress" is a registered trademark of the WordPress Foundation. RakuWP is not responsible for the WordPress content management system, its core software, its security, or its updates. Our Service provides add-on functionality that integrates with WordPress, but we do not develop, maintain, or control any part of the WordPress CMS itself. Any issues arising from the WordPress core software are outside the scope of our responsibility and support.

11. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to scheduled maintenance, emergency updates, or circumstances beyond our control. We will make reasonable efforts to notify users in advance of planned downtime.

RakuWP is not responsible for any losses resulting from service interruptions, including but not limited to lost revenue, traffic, or data.

12. Your Data Responsibility

While RakuWP provides backup services as part of certain plans, you are ultimately responsible for maintaining your own backups of your WordPress sites and data. We recommend keeping independent backups of your content, database, and configuration files. RakuWP shall not be held liable for any data loss that occurs on your WordPress sites.

13. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of vulnerabilities.

14. Limitation of Liability

To the fullest extent permitted by law, RakuWP and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or profits, arising from your use of or inability to use the Service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

15. Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these terms. Upon termination, your license will be revoked and you must uninstall the plugin from all sites. You may also terminate your account at any time by contacting support. Termination does not entitle you to a refund unless within the 7-day refund window.

16. Changes to Terms

We may update these Terms of Service from time to time. If we make material changes, we will notify you by email or through a prominent notice on our website at least 15 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated terms.

17. Governing Law

These terms shall be governed by and construed in accordance with the laws of Spain, without regard to conflict-of-law provisions. Any disputes arising from these terms shall be submitted to the courts of Spain.

19. AI Credits

AI Credits are consumable units used to access AI-powered features on the platform. Plan-included credits are allocated at the start of each billing cycle and expire at the end of that cycle; unused plan credits do not carry over. Purchased credit packs never expire and remain in your account until consumed. All credit purchases are final and non-refundable. Credit pricing and allocations are subject to change with reasonable notice. Credits have no monetary value and cannot be transferred, resold, or exchanged.

20. Simple Analytics

Service Description. Simple Analytics is a lightweight, cookie-free website analytics service included with all plans. It tracks pageviews, visitor behavior, and traffic sources without using cookies or storing IP addresses.

Event Quotas. Each plan includes a monthly event allocation: Free — 500 events, Pro — 15,000 events, Plus — 50,000 events, Ultra — 200,000 events. Additional events can be purchased on paid plans without upgrading. Events exceeding the quota may be dropped until the next billing cycle.

Data Retention. Analytics data is retained based on the plan tier: Free — 3 months, Pro — 1 year, Plus — 3 years, Ultra — 5 years. Data beyond the retention period is automatically and permanently deleted.

Data Ownership. Analytics data belongs to the account holder. Upon account deletion, all analytics data is permanently removed within 30 days.

Accuracy Disclaimer. Analytics data is provided as-is. RakuWP does not guarantee 100% accuracy of visitor counts, geolocation, or device detection. Bot filtering is best-effort.

Third-Party Geolocation. IP addresses are sent to a third-party geolocation API for country, region, and city resolution. IP addresses are not stored by RakuWP.

21. Security & Monitoring Services

Nature of the service. The security and monitoring features provided by RakuWP (including but not limited to Security Basics, Login Monitoring, File Integrity Monitoring, Malware Scanner, and Vulnerability Tracking) are assistance and informational tools designed to help you improve your site's security posture. They do not constitute a comprehensive security solution and do not replace professional security audits, dedicated security services, or your own due diligence.

No security guarantee. RakuWP does not guarantee that these tools will detect all security threats, vulnerabilities, malware, or unauthorized access attempts. No automated scanning tool can identify every possible threat. The absence of alerts or scan findings does not mean your site is free of security issues.

Malware Scanner disclaimer. The Malware Scanner uses pattern-based detection and may produce false positives (flagging legitimate code as suspicious) or false negatives (failing to detect actual malware). Scan results are provided as guidance only and should be reviewed by a qualified professional before taking action. RakuWP is not liable for any damage, data loss, or security breach resulting from undetected malware, false positive detections, or actions taken based on scan results.

Vulnerability data. Vulnerability information is sourced from third-party databases and feeds. RakuWP does not independently verify the accuracy, completeness, or timeliness of this data. Vulnerability reports should be treated as informational and cross-referenced with official sources before making decisions.

User responsibility. You remain solely responsible for the security of your WordPress sites, including keeping WordPress core, themes, and plugins up to date, using strong credentials, implementing server-level protections, and maintaining independent security measures. RakuWP's security tools supplement but do not replace these responsibilities.
